The standard enterprise AI playbook optimizes for speed to production. Move fast, get models into production, measure outcomes, iterate. That playbook works in unregulated contexts. Applied to regulated industries without modification, it produces models that reach production and then fail regulatory review months later, requiring expensive redesign or withdrawal from production entirely.

The Regulatory Landscape: What Governs AI in Your Sector
SR 11-7: Model Risk Management
The Federal Reserve's SR 11-7 guidance (2011, updated) governs model risk management at US banks. Every AI model used in credit, trading, pricing, or risk decisions is a "model" under SR 11-7 and requires a Model Development Document, independent validation, and ongoing monitoring. Validation cycles typically take six to ten weeks. Non-validated models cannot be used in production for regulatory purposes. This timeline cannot be compressed without regulatory risk.
FDA Software as a Medical Device (SaMD)
AI that aids clinical decision-making (diagnosis support, treatment recommendations, patient monitoring) is typically classified as SaMD under FDA guidance. The appropriate regulatory pathway (510(k), De Novo, or PMA) depends on the risk classification of the device. SaMD regulatory strategy should be established before development begins, not after, as the choice of pathway affects technical requirements and algorithm locking requirements.
EU AI Act (2024)
Effective from August 2026 for most provisions. The EU AI Act classifies AI systems into four risk tiers: prohibited, high-risk, limited-risk, and minimal-risk. High-risk systems (which include most AI used in credit decisions, hiring, medical devices, critical infrastructure, and law enforcement) require conformity assessment, risk management systems, data governance documentation, transparency and logging requirements, and human oversight mechanisms before deployment.
State Insurance Regulations and NAIC AI Principles
Insurance AI is regulated primarily at the state level in the US, creating a patchwork of requirements that vary by jurisdiction. The NAIC Model Bulletin on the use of AI by insurers (2023) provides a baseline framework. Key requirements include: fairness testing for protected classes in underwriting and claims, explainability for adverse decisions, and audit trails for AI-assisted claim determinations. Multi-state insurers must navigate the most restrictive requirements across all operating states.
The Governance-First AI Framework for Regulated Industries
In unregulated contexts, governance is typically introduced in Phase 3 of an AI program, after quick wins have demonstrated value. In regulated industries, governance must be designed in Phase 1 because the governance requirements determine the technical architecture of every model that follows.

Risk Classification: Know What You Are Building Before You Build It
Classify every proposed AI use case against the applicable regulatory framework before development begins. SR 11-7 applicability, EU AI Act risk tier, FDA SaMD pathway, NAIC fair lending requirements: these classifications determine the governance overhead for the use case and must be factored into the business case and timeline. Use cases that seem fast in a strategy deck often have a six-week validation cycle hidden inside them.

Documentation Architecture: Build the Audit Trail From Day One
SR 11-7 requires a Model Development Document for every model. EU AI Act requires technical documentation that evidences conformity. FDA requires device documentation for SaMD. Designing the documentation architecture before development ensures that documentation requirements drive development decisions (such as which model architecture provides sufficient explainability) rather than being retrofitted after the model is built.

Explainability Infrastructure: Individual-Level, Not Just Global
Regulatory requirements in financial services and healthcare increasingly require individual-level explanations: not "on average, this model uses these features" but "for this specific decision, these were the three most influential factors." Building SHAP or LIME explainability infrastructure into the model from the start is far less expensive than retrofitting it. For EU AI Act high-risk systems, the explanation infrastructure must also support human oversight requirements.

Fairness Testing: Systematic, Not Ad Hoc
Fair lending, disparate impact, and algorithmic fairness requirements require systematic testing across protected classes and subgroups at every stage of development and at defined intervals after production deployment. The fairness testing framework must be agreed with risk and legal before the first model enters development. Ad hoc fairness testing after a model is built cannot satisfy regulatory requirements that require documented systematic methodology.

Production Monitoring: Regulatory Reporting Built In
Regulated models require ongoing monitoring that produces regulatorily reportable output. PSI monitoring, performance stability monitoring, fairness drift monitoring, and model challenger infrastructure must be built as part of the production deployment, not added later. The monitoring outputs feed directly into the model risk reporting that goes to the Chief Risk Officer, audit committee, and regulatory examinations.

Planning an AI program in a regulated industry using standard timelines from unregulated case studies will produce a program that is systematically behind schedule from Month 2 onward. Here are the mandatory timeline adjustments for the most common regulatory requirements.
- SR 11-7 model validation: Add six to ten weeks per model for independent validation. For complex models (deep learning, ensemble methods), plan for ten weeks. These cycles cannot be run in parallel with development because the validator needs the finished model.
- EU AI Act conformity assessment for high-risk systems: Add six to eight weeks for documentation preparation and internal conformity assessment. If a notified body is required (typically not required for internal enterprise use but required for software placed on the market), add twelve to sixteen weeks.
- FDA 510(k) clearance for SaMD: Add six to twelve months for the FDA review timeline after submission. The submission preparation itself (clinical validation, technical documentation, 510(k) summary) takes four to six months. FDA SaMD development should begin twelve to eighteen months before the intended clinical deployment date.
- State insurance AI approval: Varies by state. California and New York have the most developed AI review processes for insurance, adding four to eight weeks per state where the product will be deployed.
These timelines are not conservative estimates: they are minimum timelines under favorable review conditions. Programs that begin regulatory review late in the development cycle face the choice between delaying production or accepting governance risk. Neither is acceptable for production AI in regulated industries.
