Six Privacy Controls That Enable Compliant AI at Scale

Privacy-by-design is the only sustainable approach to AI privacy compliance. Retrofitting privacy controls onto deployed AI systems is expensive, often technically constrained, and creates the worst-case scenario of compliance gaps that exist during the highest-risk early deployment period. These six controls, implemented before deployment, define the practical framework for compliant AI at scale.

Data Protection Impact Assessment (DPIA) for Each AI Use Case

GDPR Article 35 requires a DPIA for any processing likely to result in high risk to individuals, which covers most enterprise AI deployments involving personal data. Conduct a DPIA before deploying any AI application that processes personal data, not after. The DPIA must document the specific personal data processed, the legal basis, the identified risks, and the mitigation measures implemented.

Training Data Inventory with Legal Basis Documentation

Document the specific datasets used to train each AI model, the data subjects covered, the legal basis for each dataset, and whether the processing for AI training is compatible with the original collection purpose. This is the single most common gap in enterprise AI privacy programs and the first thing a regulator will request when investigating an AI privacy complaint.

Human Oversight Mechanism for Automated Decision Systems

For any AI system that makes decisions with significant effects on individuals, implement a documented human oversight mechanism that can review, override, and explain individual decisions. This is required under GDPR Article 22 and is a due diligence requirement under the EU AI Act for high-risk AI systems. The oversight mechanism must be genuine, not performative.

Third-Party AI Vendor Due Diligence and DPA Management

Treat every AI model provider as a data processor and execute a Data Processing Agreement before sending any personal data through their API. Conduct a transfer impact assessment for any cross-border transfer. Review the vendor's sub-processor list. Many enterprises are currently sending personal data through LLM APIs under standard API terms that do not meet their GDPR DPA obligations.

Data Minimization in AI Inputs

Apply data minimization principles to AI system inputs: do not send personal data to a model if the task can be completed without it. Implement masking and pseudonymization of personal data in RAG retrieval pipelines and model context windows where technically feasible. This reduces both privacy exposure and prompt injection exfiltration risk simultaneously.

Erasure and Subject Rights Response Process for AI Systems

Document your organization's position on right-to-erasure requests where the subject's data was used in model training. Implement technical controls to honor erasure for production inference systems at minimum. Develop a process for new training data that tracks which data subjects have pending deletion requests and excludes their data from future training runs.

The Practical Starting Point: The AI Privacy Inventory

Most organizations do not have a complete inventory of where personal data is being processed by AI systems. Shadow AI deployments, departmental GenAI tool subscriptions, and vendor-embedded AI features in existing SaaS applications create significant personal data processing that the privacy team is unaware of. Before implementing privacy controls, you need to know what you are controlling.

A structured AI privacy inventory covers four questions for each AI system: what personal data does it process, what is the legal basis for that processing, is there a DPA with each AI vendor involved, and has a DPIA been completed. For most enterprises, completing this inventory reveals that the majority of deployed AI systems have not been through a DPIA and that DPAs are missing for multiple AI vendors currently processing personal data in production.

This is not an indictment of your privacy team. It is a reflection of how quickly AI adoption has outpaced governance processes. The organizations that will navigate the increasing regulatory enforcement environment successfully are those that use the current window, before major enforcement actions, to systematically close the gaps their inventory reveals.
